These Terms and Conditions govern your use of the MilkMade mobile application, operated by AppyFox (“we”, “us”, “our”).
By downloading, installing, or using MilkMade, you agree to these Terms and Conditions.
1. About the App
MilkMade is a tracking tool designed to help parents record and monitor:
Breastfeeding and pumping activity
Formula feeding
Milk storage (including freezer supply)
Baby-related data such as height, weight, head circumference, and general notes.
The App also provides general educational content related to early parenting.
MilkMade is intended for personal use only.
2. No Medical Advice
MilkMade is not a medical or healthcare service.
The information provided in the App, including videos, educational material, tracking tools, and graphs, is for general informational and educational purposes only and is not intended to replace professional medical advice, diagnosis, or treatment.
You should always seek advice from a qualified healthcare provider regarding your baby’s health, feeding, or development.
You use the App at your own risk.
2A. Insights, Guidance and Educational Content
MilkMade may provide summaries, trends, charts, graphs, feeding insights, growth insights, educational content, guidance, tips, suggestions, notifications, reminders, or other information generated from data entered into the App.
These insights and materials are provided for general informational and educational purposes only.
Any insights, trends, summaries, calculations, predictions, recommendations, guidance, or educational content:
are generated from user-entered information and may be incomplete, inaccurate, unavailable, or unsuitable for your individual circumstances;
are not intended to diagnose, treat, cure, prevent, or monitor any medical condition;
do not constitute medical, nursing, midwifery, lactation, dietetic, developmental, or other professional healthcare advice;
should not be relied upon as a substitute for professional medical assessment or clinical decision-making; and
should not be used as the sole basis for making decisions regarding feeding, growth, nutrition, medication, health, development, or medical care.
You acknowledge that any guidance, suggestions, educational content, or insights provided through the App are general in nature and may not apply to your baby or circumstances.
If you have any concerns regarding your baby's feeding, growth, health, development, or wellbeing, you should seek advice from an appropriately qualified healthcare professional.
AppyFox makes no representation or warranty regarding the accuracy, reliability, completeness, suitability, or usefulness of any insight, guidance, recommendation, chart, graph, summary, trend analysis, or educational material provided through the App.
Any growth charts, percentile calculations, growth trends, weight analyses, height analyses, head circumference analyses, developmental information, or similar growth-related information displayed by the App are provided for informational purposes only and should not be relied upon as a substitute for professional medical assessment.
AppyFox does not guarantee the accuracy of any growth-related calculations, interpretations, projections, or recommendations generated by the App.
3. User Responsibility
You are responsible for:
The accuracy of any data you enter into the App
How you interpret and use the App’s tracking features and graphs
Ensuring the App is suitable for your personal circumstances
Maintaining backups of your data
We do not guarantee that the App will meet your specific needs or produce accurate insights.
You must be at least 18 years old to use the App.
You are responsible for reviewing information entered into the App and ensuring that any decisions relating to your baby’s health, feeding, growth, or development are made in consultation with an appropriately qualified healthcare professional where necessary.
3A. Emergency Situations
MilkMade is not intended for use in emergencies and is not designed to provide emergency alerts, emergency monitoring, emergency medical advice, or emergency healthcare services.
You must not rely on the App to identify, diagnose, monitor, prevent, or respond to medical emergencies or urgent health situations.
If you believe your baby or any person may be experiencing a medical emergency, you should immediately contact your local emergency services, healthcare provider, or seek urgent medical attention.
Do not delay seeking medical advice, medical treatment, or emergency assistance because of information displayed in the App or because the App is unavailable, inaccessible, delayed, inaccurate, or not functioning as expected.
AppyFox accepts no responsibility or liability for any injury, illness, death, loss, damage, or adverse outcome arising from a failure to seek appropriate medical attention or reliance on the App during an emergency or urgent medical situation.
4. Data Storage
MilkMade operates primarily on your device.
No user accounts are required
We do not store your personal tracking data on our servers
All data entered remains locally on your device
You are responsible for maintaining your own backups. Deleting the App may result in permanent loss of your data.
5. Photos and User Content
You may upload photos and other content (for example, photos of your baby) for personal use within the App.
You retain ownership of any content you upload. We do not access, store, or use this content outside of the App.
You are responsible for any content you upload and must ensure you have the right to upload and use that content.
6. Payments
MilkMade is available as a subscription through app distribution platforms such as the Apple App Store.
All payments are processed by the relevant platform provider. We do not process or store your payment details.
Refunds are subject to the policies of the platform through which you purchased the App.
All purchases are final except as required under applicable law.
7. Apple App Store Terms
If you download the App from the Apple App Store, you acknowledge that:
Apple is not responsible for the App or its content
Apple has no obligation to provide maintenance or support services for the App
Apple is not responsible for any claims relating to the App, including product liability claims, legal claims, or consumer protection claims
Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce these Terms against you
8. Intellectual Property
All content within the App (excluding user-uploaded content), including:
Design
Branding
Text
Videos
Features and functionality
is owned by AppyFox and protected by applicable intellectual property laws.
You may not copy, reproduce, modify, distribute, sell, or exploit any part of the App without our written permission.
We may suspend, modify, or discontinue the App at any time without liability to you.
9. Acceptable Use
You agree not to:
Use the App for unlawful purposes
Attempt to reverse engineer, decompile, or interfere with the App
Attempt to gain unauthorised access to the App or its systems
Misuse or exploit the App in any way
We reserve the right to restrict or terminate access to the App if these Terms are breached.
10. Limitation of Liability
To the maximum extent permitted by law, AppyFox is not liable for:
Any loss of data
Any decisions made based on App content
Any health outcomes related to use of the App
Any indirect, incidental, or consequential loss
Any loss resulting from App interruptions, bugs, or device incompatibility
Use of the App is at your own risk.
Nothing in these Terms excludes, restricts, limits, or modifies any rights or remedies you may have under the Australian Consumer Law or any other applicable consumer protection laws that cannot legally be excluded.
If you are entitled to statutory rights under the laws of your country or jurisdiction, those rights remain unaffected by these Terms.
Where goods or services are supplied under these Terms, our liability for breach of any non-excludable rights under the Australian Consumer Law is limited, at our option, to the resupply of the services or the cost of having the services supplied again.
For the avoidance of doubt, AppyFox is not liable for any loss, injury, damage, claim, or adverse outcome arising from reliance on any insight, recommendation, guidance, educational content, chart, graph, trend analysis, notification, reminder, or other information generated or displayed by the App.
11. App Provided “As Is”
The App is provided on an “as is” and “as available” basis.
We make no warranties or representations that the App will be uninterrupted, error-free, secure, or free from viruses or harmful components.
To the extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
12. Indemnity
You agree to indemnify and hold harmless AppyFox, its owners, employees, and affiliates from any claims, damages, losses, liabilities, and expenses arising out of:
Your use of the App
Your breach of these Terms
Any content you upload
Any misuse of the App
13. Changes to the App
We may update, modify, suspend, or discontinue features of the App at any time without notice.
We do not guarantee that the App will be compatible with all devices or operate without interruption or error.
14. Changes to These Terms
We may update these Terms from time to time. Continued use of the App after updates means you accept the revised Terms.
Your use of the App is also subject to our Privacy Policy.
15. Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be removed and the remainder of these Terms will continue in full force and effect.
16. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and AppyFox regarding your use of the App.
17. Force Majeure
AppyFox will not be liable for any failure or delay in providing the App due to circumstances beyond our reasonable control, including natural disasters, internet outages, cyberattacks, power failures, government actions, or failures of third-party service providers.
18. Governing Law
These Terms are governed by the laws of Victoria, Australia. Any disputes arising in connection with these Terms will be subject to the jurisdiction of the courts of Victoria, Australia.
19. Subscriptions and Third-Party Services
MilkMade uses RevenueCat to facilitate the management of in-app purchases and subscriptions. By purchasing a subscription or premium feature, you acknowledge that certain information relating to your purchase and subscription status will be processed by RevenueCat to verify, manage, and restore your purchases.
All payments are processed by the Apple App Store or Google Play Store under their respective terms and conditions. MilkMade does not collect or store your payment card information.
Continued access to subscription features is subject to successful payment processing and the terms of the relevant app store. Subscription renewals, cancellations, refunds, and billing are governed by the policies of the Apple App Store or Google Play Store.
